I'm not sure if this is exactly what I'm after, but if someone has an orchard, an ancient orchard, is a TPO the right thing to prevent them pulling it out and trashing it, or is there something else?

Anyone know how one could apply for a TPO, or whatever?

Don't know if you will get a TPO on an orchard, they are considered a crop really.

Your local council will advise though.

Why are they going to pull it out? I know a few years ago government policy encouraged people to pull them out but I thought that was changed? Could you find out if they could claim any grants to help look after it, is there anything the locals could do to try and make it profitable?

Phone your local council and talk to the tree officer.
Anyone can apply for a tree (or group of trees) to be protected by a TPO, but obviously, they will have certain criteria to meet.
They may have all the information on your council website.

There are also conservation areas, but I have no idea about how they are set up.

Don't know if they are. It's next to my house, and we'd love to buy it from the local (deceased) farmer's estate. However, we know one or two others are interested, and potentially, they might want to put either polytunnels or houses on it. Houses will probably never get through, but the polytunnels would be horrible. So, I'd like to buy it and run the odd pig in it, and leave it as is. If I can't, I want to do whatever I can to ensure the very, very rare bats that live there aren't disturbed.

Can't really be profitable, and the grants are minimal (compared to polytunnel profits).

Yes you can - I enquired once for the orchard behind my house, and contacted some orchard preservation people, who said it was possible. Ant they have TPO#s on another ancient orchard near us.

Now, I just need to remember the name of the orchard preservation people......
I'm going to rack my brains and scratch my head.....




But bats are better !

You've got to establish some kind of environmental or historical value to get a TPO, speak to the parish tree warden

speaking from experience, getting a TPO put on someone else's trees without discussing it with the owner first can make them very cross and unco-operative
